Indiana Recodifies Consumer Lending Laws

Recently, Indiana passed a bill that, among other things, recodifies multiple consumer lending laws into a single “Consumer Lending” title without making substantive changes to the laws.  The new “Consumer Lending” title 37 of Indiana law will include, in separate articles, the following laws: (i) first lien mortgage lending; (ii) the Uniform Consumer Credit Code; (iii) small loans; (iv) mortgage rescue protection fraud; and (v) home loan practices.

These changes are effective on July 1, 2026.  However, a person regulated under these recodified sections has until July 1, 2027, to amend any document, website, or business communication to comply with the recodification of the statutes.
