WY Protects Lien Priority for Common Loan Modifications
Under Wyoming’s newly-enacted Uniform Mortgage Modification Act, certain loan modifications will not affect the original mortgage’s lien priority even if the modification is not officially recorded. The common types of mortgage modifications that will retain their original lien priority include, among others, modifications that extend the maturity date, decrease the interest rate, change an adjustable rate to a fixed rate, or reduce the principal, accrued interest, or other unpaid amounts.
The law will apply to mortgage modifications made on or after July 1, 2026, regardless of when the original mortgage was signed.
