OMB Publishes BCFP’s Fall 2018 Rulemaking Agenda

The OMB published the BCFP’s new rulemaking agenda which included proposed rules implementing the Economic Growth, Regulatory Relief, and Consumer Protection Act that was signed into law in May 2018 as well as rules implementing provisions of and amendments to the Dodd-Frank Act.

The rulemaking agenda lists the regulatory matters the BCFP reasonably anticipates having under consideration during the period of October 1, 2018 to September 30, 2019.  Specifically, the Fall 2018 Agenda details items that are in prerule stage, proposed rule stage, and final rule stage.  Under the prerule stage, there are rules and amendments related to higher priced mortgage loans, Property Assessed Clean Energy financing, and the public release of HMDA data.  Under the proposed rule stage, there are rules and amendments related to the Expedited Funds Availability Act, the Debt Collection Rule, the Civil Penalty Inflation Adjustment Rule, the Payday, Vehicle Title, and High-Cost Installment Loans Rule, and HMDA.  Under the final rule stage, there are rules and amendments regarding FOIA, FCRA, and the Prepaid Accounts Rule.  Many of these proposed rules listed in the Fall 2018 rulemaking agenda are a continuation of the Spring 2018 rulemaking agenda.
