NYDFS Publishes 2026 Regulatory Agenda, Review of Rulemakings

The New York Department of Financial Services (NYDFS) recently published in the state register its 2026 regulatory agenda and the three- and five-year review of rulemakings. 

The agenda provides an overview of banking regulation proposals, among other matters, including:

  • Enhancements to advertising, disclosure and conduct rules for mortgage bankers and brokers;
  • Amendments to provisions regarding maximum charges for payments made against insufficient funds, uncollected balances, and return items; and
  • Amendments to annual reporting requirements for licensed lenders, sales finance companies, and premium finance agencies.

The three- and five-year review includes a high-level summary of banking rules promulgated in 2023, 2021, 2016, and 2006, and financial services rules promulgated in 2023 and 2011. 

NYDFS invites public comments on the continuation or modification of the rules provided in the review.  Comments are due March 29, 2026.
