FTC’s Bureau of Consumer Protection Launches New Program

The FTC’s Bureau of Consumer Protection (BCP) has announced a new program that gives the public, businesses, and industry groups a dedicated channel to bring problems with the FTC’s rules directly to the attention of the BCP.

Specifically, the new program calls for submissions identifying genuine ambiguities in the FTC’s rules, substantive conflicts between those rules and other statutes or rules, and other significant issues with the rules themselves.

The dedicated channel to reach the BCP is a submission form, which is available on the BCP’s program website.  If the BCP determines that a response to a submission is warranted, the BCP will publish guidance so that the public may benefit.

However, the BCP has made clear that it will not respond to submissions that can be answered by reviewing the text of the rule, existing plain-language guidance, or formal advisory opinions.
