Alex focuses on federal and state regulatory compliance matters related to the financial services industry. She regularly advises both depository and non-depository institutions on a variety of matters, including compliance with federal and state laws and regulations pertaining to the mortgage industry and related financial services fields. Prior to joining the firm, Alex worked in-house at a mortgage company where she focused on compliance with both federal and state laws and regulations.

Representative Matters

  • Draft and review compensation agreements for loan originators and branch managers for compliance with the Loan Originator Compensation Rule under Regulation Z and the federal employment requirements under the FLSA
  • Advise settlement service providers on compliance with RESPA Section 8 in connection with joint ventures, marketing services agreements, lead sales, and affiliated business arrangements
  • Advise mortgage lenders on fair lending compliance
  • Review lenders’ compliance with ECOA and FCRA notice requirements and HMDA reporting requirements
  • Advise clients on foreign language requirements under both state and federal laws and regulations
  • Advise clients on required mortgage lender, broker, and servicer licenses and approvals based on the client’s functions and activities
  • Review and advise clients on government-insured and proprietary reverse mortgage lending programs and related documentation for compliance with federal and state law requirements in all 50 states and the District of Columbia
  • Draft and review loan documents and consumer disclosures for forward and reverse mortgage lending programs for both mortgage lenders and document preparation companies
  • Draft mortgage broker and correspondent agreements for various clients
  • Review client debt collection practices for compliance with applicable state and federal regulations
